1. General

1.1 Scope

The General Terms and Conditions provide an overview of our services on www.the-bodyworkers.de. We offer:

Registration is required for all sports classes, retreats & events, and personal training/coaching in our program. The booking becomes binding upon confirmation of the registration by The Bodyworkers. Contracts between The Bodyworkers and the customers (also referred to as "participants") are concluded by offer and acceptance in accordance with §§ 145 ff. BGB. Registration or booking of courses, workshops, or other services and events constitutes a binding offer by the customer to conclude a corresponding contract. Our services are aimed at health promotion and prevention. Participation is at one's own risk. The trainer must be informed of any injuries, illnesses, or pregnancy before a training session. The trainer's instructions must always be followed.

1.3 Behavior in the Studio

The training area may only be entered with clean indoor sports shoes, barefoot, or with socks. The studio, especially the equipment, toilet, and changing room, must be treated with care. Willful damage and theft will be reported.
We treat all persons with respect - regardless of origin, skin color, religion, and gender. We expect the same from our participants. Disrespectful or unfriendly behavior will result in a ban from the premises.

1.4 Photo Policy

By participating in our services, the participant agrees that images and/or video material may be created during the services and used for advertising purposes (e.g., on Instagram). If the participant does not wish this, we will, of course, respect this if notified beforehand.

2. Indoor, Outdoor & Online Sports Courses (The Bodyworkers® GmbH)

2.1 Service Offering

The Bodyworkers® GmbH offers a studio for yoga, pilates, and group fitness training. The current program can be found on our website at www.the-bodyworkers.de. Program changes are reserved. Participation in the training sessions can occur:

  • By paying for single sessions
  • By redeeming credits on class pass cards
  • Through subscriptions with fixed terms
  • Through partner portals (Urban Sports Club, Wellhub, Wellpass, Eversports, etc.)

Participation in classes is only possible with prior booking through our website (Fitogram), Eversports, or the partner portals. The general terms and conditions of the partner portals also apply to bookings made through them.

The studio can also be rented for full-day events, workshops, photo shoots, etc.

2.2 Booking

2.2.1 Class Pass Cards & Subscriptions
Participation in a class session can be done by redeeming a credit on a digital class pass card or a subscription. A credit will be deducted from the contingent for each class session attended. The costs for class pass cards and subscriptions are listed on the homepage. They can be used for all classes on the current schedule. Livestream-only class pass cards can only be used for livestreams. Studio spots can be booked subject to availability. Possession of a class pass card or a subscription does not constitute a right of priority. We recommend booking studio classes in advance.
The validity of the class pass cards is visible in the personal account. After the expiration of the validity, The Bodyworkers® GmbH is not obliged to accept balances of unused sessions.

2.2.2 Late Cancellation and No-Shows
The participant is obliged to cancel their spot immediately if they cannot attend. Our cancellation deadlines apply. For late cancellations or no-shows, the following rules apply:

  • Class pass card / subscription: The used credit will expire.
  • Unlimited subscription: A warning will be issued for the first time. From the second time onwards, a penalty fee of €5 for late cancellations and €10 for no-shows will be charged.

2.2.3 Waiting List

If a class is fully booked, the participant can book a spot on the waiting list. By booking a spot on the waiting list, a credit is reserved. If a spot becomes available, the participant will automatically move up and be notified immediately by email. As moving up can occur at very short notice, the participant is obliged to cancel the waiting list spot if attendance or participation is no longer possible.

2.2.4 Studio Rental

2.3 Validity of Value Cards

All value cards such as vouchers, class pass cards, etc., are legally valid for three years.

 

2.4 Payment Terms

We only offer digital payment options. For the purchase of our class pass cards and products in the studio, the payment options PayPal, debit card, credit card, and ApplePay/GooglePay are available.

Our subscriptions are collected by direct debit. For failed debits, the payment service provider goCardless charges a fee of €5.80.

Studio rentals are payable in advance at 100% on invoice.

Cash payment is not possible.

2.5 Cancellation Conditions

In the event of cancellation, we reserve the right to charge the following cancellation fees:

2.5.1 Sports Classes

  • Studio and outdoor classes: 100% of the class fee for cancellations less than 12 hours before the class.
  • Livestreams: 100% of the class fee for cancellations less than 3 hours before the class.

2.5.2 Studio Rentals

2.6 Exchange / Refund

2.6.1 Sports Classes
As a rule, no refunds are given for sports classes. For timely cancellations, the credit will be credited for rebooking. Our cancellation conditions apply. Partial or full exchanges of products are excluded.
Balances for unused products will not be refunded but can be transferred to other persons.

2.6.2 Studio Rentals
For studio rentals, the corresponding portion of the total price will be refunded to the account from which the payment was received, in accordance with our cancellation conditions, in the event of timely cancellation.

 

3. Retreats & Events (The Bodyworkers® Events, Marina Amato)


3.1 Service Offering

The Bodyworkers® Events offers fitness, pilates, and yoga retreats. The dates and locations are published on our website and can be booked as long as places are available. The offers are regularly updated on the website. Accommodation, meals, and the program are always current on the website. Program changes are reserved. Special wishes or needs must be communicated in advance.


3.2 Booking

3.2.1 Registration
Participation in retreats is done by binding booking on our website. The booking of retreats is completed by submitting the registration form. The participant will receive a booking confirmation email from us.

4. Personal Training & Coaching (The Bodyworkers® Coachings, Matthias Vollmer)

4.1 Service Offering

The Bodyworkers® Coachings offers comprehensive personal training and coaching tailored to the needs and goals of our customers. Our services include fitness and wellness coaching, nutritional counseling, mental strength coaching, and more.
Personal training and coaching take place in a friendly and supportive environment, either in our studio or at another agreed location. The duration and frequency of sessions are agreed upon in advance and can be adjusted as needed. Each coaching program begins with a detailed initial consultation, where goals, expectations, and any health restrictions are discussed.

4.2 Booking

Participation in our 10-week coaching program is possible with the following packages:

  • Intensive
  • Basic
  • Do-It-Yourself

Our website provides information on the current prices and services of the individual packages. Additionally, individual services can be agreed upon, with prices depending on the agreed services.
After clarifying all details and the availability of a coach, the customer will receive a contract by email.

4.3 Payment Terms

After concluding the contract, we will send the invoice for the booked coaching/personal training by email.
The total amount for individual personal training sessions must be received in our account no later than 48 hours before the appointment.
For coaching programs, 50% of the amount is due before the first appointment, and the remaining 50% at halftime.

4.4 Cancellation Conditions

4.4.1 Individual Personal Training
Cancellations for individual personal training sessions are free of charge up to 48 hours before the appointment. In case of timely cancellation, a replacement appointment will be scheduled subject to the coach's availability; refunds are excluded. For late cancellations, the full fee will be charged.

4.4.2 10-Week Coaching
Early termination of the contract is possible under the following cancellation conditions:

  • 91+ days: 25% of the total price
  • 15-90 days: 50% of the total price
  • 0-14 days: 100% of the total price

In case of prevention due to personal reasons (e.g., illness) of up to 10 days during the contract period, the period will not be extended. In the event of an illness duration of more than 10 consecutive days, the contract can be paused upon presentation of a medical certificate. The certificate must be submitted immediately. Outside the contract period, a maximum of one session (Basic) or two sessions (Intensive) can be made up.

4.5 Exchange / Refund

As a rule, personal training and coaching are excluded from exchange. In the case of early termination of a multi-week coaching program, the corresponding portion of the total price will be charged or refunded to the account from which the payment was received, in accordance with our cancellation conditions.
